Purchase Terms & Conditions

These Purchase Terms & Conditions apply to all purchases of products and services, including Digital Content (defined below), sold by Delivering Delight, (“DD”, “we”, “our”, or “us”) from our online store with a homepage located at www.DeliveringDelight.com (the “Website”).

By placing your order for Product, you accept and are bound to these Purchase Terms & Conditions as well as any Product-specific rules or usage provisions specified on any Product or description on a Product detail page. In addition, your use of the Website is subject to our Privacy Policy available at https://DeliveringDelight.com/privacy-policy. These Purchase Terms & Conditions shall apply only to your purchase through the Website. Any purchases you make of our products or services by any other means or method will be governed by a separate purchase agreement between you and DD.

1. Eligibility. By placing an order, you represent and warrant that you have read these Purchase Terms & Conditions, are at least eighteen (18) years of age, and you agree to be bound by these Purchase Terms & Conditions. If you are not at least eighteen (18) years of age, or do not wish to be bound by these Purchase Terms & Conditions, you are not authorized to place an order.

2. Digital Content. The Website offers downloads of digitized materials such as e-brochures, workshop slides, artwork, video recordings, and other content (individually and collectively, “Digital Content”)

a) Limited License to Digital Content. DD grants you a non-exclusive, non-transferable, non-assignable, non-sublicenseable, license to the Digital Content effective upon receiving. You may copy, store, transfer and burn the Digital Content only for your personal, non-commercial use, subject to and in accordance with these Purchase Terms & Conditions.

b) Licensing Use and Reprint Rights. To license, reprint, repackage, reuse or distribute any of the information on this website as part of an article, book, magazine, pamphlet, website, course, program, event or other application, please contact us with your request.

3. Purchases. When you purchase any DD Products, you will be asked to supply your financial information such as full name, address and credit card and/or other billing information to us or an authorized third party on our behalf. You agree to provide us or such third party with accurate, complete and current information complying with these Purchase Terms & Conditions. You shall be responsible for all charges made in your Product order including any applicable taxes.

a) Payment. Terms of payment are within DD’s sole discretion, and unless otherwise agreed with DD, payment must be received by DD prior to DD’s acceptance of an order. Your right to any available Products is conditional on our receipt of the appropriate payment in advance. If payment cannot be charged or if a charge is refunded for any reason, you agree that we reserve the right to cancel your order.

b) Cancellations. We reserve the rights to refuse or cancel any order placed with us. In the event that we make a change or cancel an order, we will attempt to notify you with our reasons by contacting the e-mail and/or billing address/contact number provided at the time the order was made.

c) Product Descriptions; Pricing. We strive to be as accurate as possible in describing our Products (including pricing) offered; however we do not represent or warrant that all such descriptions are complete, current or error-free. We reserve the right to correct any typographical errors, inaccuracies or omissions and to change or update any information at any time without prior notice (including after orders are submitted). If physical Product is received not as described, please contact us and return it in unused condition. Despite our best efforts, a small number of Products on the Website may be mispriced. If a Product’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

d) Shipping. Please refer to the shipping rates applicate upon checkout and allow up to 3 business days for delivery to locations inside Singapore, and up to 12 days for delivering to locations outside Singapore. Please contact us for alternative shipping rates and methods if you require faster delivery.

e) Returns and Cancellation Policy. All sales of Products or Digital Content are final. We do not accept returns of Digital Content. If you are unable to complete a download of the Digital Content purchased, please contact us. We may remove Digital Content from the Website without prior notice, therefore we encourage you to promptly download and make back-up copies of your Digital Content. To be eligible for a refund in connection with any Products (e.g. physical merchandise) purchased via the Website, the applicate Product must be returned to us in original packaging, in unused condition, and accompanied by the relevant packing slip or receipt within fourteen (14) days from the date of purchase.

f) Product Availability. All Product orders are subjected to availability.

g) Order Questions. For any inquiries regarding Product orders, please contact us via e-mail at support@DeliveringDelight.com If we have any questions about your order, you agree that we may contact you by phone, mail or e-mail.

h) No Resale. You acknowledge and agree that no Product may be directly or indirectly repackaged or resold or sublicensed or rented by you, unless specifically agreed otherwise by us in writing.

i) Risk of Loss. Upon delivering your order, you will receive a tracking code as given by the third party postal service. DD will not be liable for any losses caused during the delivery by such third party postal service.

4. Restriction on Use of Product. You acknowledge and agree that you will use any Product purchased on the Website only in a lawful manner and in accordance with these Purchase Terms & Conditions. You will not modify, edit or alter any Product in any manner without our prior written permission and use any Product in a manner that may cause any consumer confusion as to our relationship with you or any third party or that may imply that DD endorses you or your product or services.

5. Termination. Your rights under these Purchase Terms & Conditions will automatically terminate without notice from us if you fail to comply with any terms, or any terms of the Privacy Policy. In case of such termination, you must cease to all use of our Products or Digital Content, and we may immediately revoke your access to the Website without notice to you. Our failure to insist upon or enforce your strict compliance with these Purchase Terms & Conditions or the Privacy Policy will not constitute a waiver of any of our rights.

6. Amendments. We may amend the Purchase Terms & Conditions at our sole discretion via posting of the revised terms on the Website. Your continued use of our Products or Digital Content after any effective date reflected to the “Last Updated” date below evidence your agreement to be bound by it. If any provisions of these Purchase Terms & Conditions is held to be invalid or unenforceable, such provision shall be struck but the remaining provisions shall be enforced. Section headers are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. These Purchase Terms & Conditions, along with the Privacy Policy and any other written terms and conditions regulating use of the Website and Product, sets forth the entire understanding and agreement between us.

7. Third Party Beneficiary. You agree that these Purchase Terms & Conditions may be assigned by DD, in its sole discretion, to a third party Digital Content copyright owners or third party beneficiaries.
